Being covered under a group policy of company and having an Individual Policy are totally different things.

Moreover in United India, your policy will be treated as new policy, the policy condition specifically say under Exclusion section
“During the first two years of the operation of the policy, the expenses on treatment of diseases such as Cataract, Benign Prostatic Hypertrophy, Hysterectomy for
Menorrhagia or Fibromyoma, Hernia, Hydrocele, Congenital internal disease, Fistula in anus, piles, Sinusitis and related disorders, Gall Bladder Stone removal, Gout & Rheumatism, Calculus Diseases are not payable.”

The denial of claim can not be considered as wrong act, though the misselling by it’s agent is. I would say in future always ask for clarification on wording of policy beforehand.

The National and UIA are both public sector companies with different management, they work independently and are free to take their own decision as long as it is under the purview of IRDA.

There is nothing you can do against the Insurance Company as you are the third party to Insurance Contract in this matter,

The Policy was in name of Univercell and when they have accepted the settled amount then there is nothing you can do.

This is now not the matter of Insurance but mis representation by Univercell.

Well Naren,

As in your case you write letter to Insurance Broker from whom you got the letter of settlement.

You don’t need to tell the features are available in 9000/- mobile. You simply ask the basis of claim settlement mentioning you are not happy and would like to file for claim again.(hope you have not accepted the claim settled.)
also mark a copy of same to Univercell and Oriental Insurance company and wait for their reply.

One more suggestion if they ask for any further documents or clarification from you, ask them for written communication only.

Saying the same feature available in 9000/- mobile so they should say so in written letter, if they don’t accept your letter than send it by Registered Post.

I did some online research and found the following in regard of Insurance Policy you had taken for your Mobile.
If you can please also provide with copy of terms of Insurance, it will further help.

Scope of Insurance

>>The Period of Insurance is for 12 months from the Date of Purchase.
“>>For total loss, the liability of the insurer is restricted to the sum insured or the value of a new instrument on the date of claim whichever is lower.”
>>For partial loss, the cost of repair will be paid without any depreciation on parts replaced for loss or damage.
>>Policy excess : 0.5% of SI subject to minimum of Rs.100/- for each & every claim.

As the mobile model which had is not available with UniverCell and not showing on website of SAMSUNG as well so you won’t get full value settlement.

But you should Ask them basis of settlement in writing, if they claim that same features are available in phone worth Rs. 9000/- so ask them to indemnify you with 9000/- because i am not able to comprehend, how they arrived at figure of 4500/-, because even policy excess with 0.5% in your case will be 15450*0.5/100 = 77 i.e 100 Rs. only.

Was it a stand alone Mobile Insurance you had??
I would request you to mail scanned copy of Policy Documents and Claim settlement letter.

you have specifically mentioned “pick pocketing and theft” were covered, so you must have some documents to prove, and *Condition Applied are always there in policy documents.

So please send it at earliest so either we may find the solution to get you your deserved money or make you understand the terms and conditions of policy.
